Challenor Gardiner have more than 150 years of experience in the legal profession as an established firm of Oxford solicitors working for clients both in Oxfordshire and surrounding counties. With our expertise our divorce lawyers are able to advise you on the most effective route to take when it comes to your separation or divorce. In England and Wales, the law allows a divorce to take place if you have a valid marriage, have been married for longer than one year and the marriage has broken down irretrievably. You no longer have to show a specific ground for applying for a divorce as ‘no fault’ divorces became law in April 2022. Either party can apply or both can do so jointly if they are domiciled or habitually resident in the jurisdiction of England and Wales.
We understand how difficult separation can be, even when it is amicable between you and your partner or spouse and we dedicate our time and expertise to your case specifically to resolve separation issues involving your family finances and child care arrangements as soon as reasonably practicable. You and your partner will need to resolve how you will divide your assets and finances fairly through negotiation and/or family mediation. Ultimately, if no agreement can be reached either of you can make a formal application to the court for a family judge to determine the issues and make a final Order.
When there are children involved, you will also need to come to an agreement as to the child care arrangements both during and after your divorce. Inevitably, separation and divorce can be a very stressful time for both parties, but we strive to help you through the process and achieve a fair and reasonable outcome for you. The divorce process will take a minimum of 6 months, but if there are outstanding financial claims over property, capital, maintenance and pensions, we advise that you resolve those financial claims and ensure you have a financial agreement incorporated into a final financial order, which can be by consent, before an application is made for a final order of divorce is made. Our family lawyers are able to assist with various family law related matters, including civil partnership dissolution, separation agreements, cohabitation disputes and pre-nuptial agreements, wherever you live.
